What Happens When Better Job Opportunities Arise?

The AEWV offers foreign workers the opportunity to live and work in New Zealand for a period of up to three years, but what happens if you find a better job opportunity or wish to explore a different career path? Are you allowed to switch employers, change job positions, or even relocate within the country? These questions often arise, and understanding your options is crucial to making informed decisions about your career and future in New Zealand.

Whether you're seeking greater opportunities, a change in location, or a different working environment you will likely need to apply for a Variation of Conditions.

What is a Variation of Conditions (VOC)?

A VOC is an Immigration NZ form that you are required to fill in to alter your working conditions or your job (i.e. altering your employer, job position, location, or a combination of these factors)

What Do I Need to Supply With a Job Change Application?

Before you start your application you will need to ensure you have the following:

  • A Job Offer & Employment Agreement including Job Description
  • A cover letter detailing how long your notice period is (if applicable)
  • Your Job Check Approval Number
  • Qualification evidence if you are changing occupation/role


What Do I Need to Supply With a Job Change Application?

What is the Acceptance Criteria for your Job Change?

  • Your employer must be accredited
  • The role you are applying for must have a valid Job Check application
  • Your wage must meet the minimum wage requirements unless it meets the exemption criteria.

To be eligible for the Job Change, your new employer must be authorised to hire migrants under the AEWV (Accredited Employer Work Visa) scheme and possess a valid job check for the position you are applying for. This job check approval number will be included in your application.

You will then be issued a Job Check token that should align with the parameters of your new employment. For instance, if you intend to change both the employer and location conditions on their AEWV, you need to acquire a Job Check token that corresponds to the new employer, the same role, and the desired new location.

If you intend to switch to a job with a salary below the median wage, it must meet the exemption criteria set out by the Government. If your current visa permits you to stay longer than the exemption period you will need to apply for a new visa which reflects these dates.

What Happens if You Want to Change Role or Occupations

In the case you are changing the role or occupation condition on an AEWV, you must provide supporting evidence to prove you meet the suitable qualification requirements outlined in the Employer's Job Check application. This evidence is essential to ensure that the individual is qualified to fulfil the specific role or occupation as specified in the Job Check application.

Currently, there is a fee of $210 to apply for a job change, this can be paid through the Immigration New Zealand website.

The government has increased the median wage to $27 per hour from 19 July. Any Skilled Migrant residence application lodged after this date will need to include a skilled job offer that pays at least $27 per hour. For some lower-skilled occupations, the minimum pay rate increases to $40.50 per hour.

From 19 July 2021

  • The median wage used to assess Essential Skills Work Visa applications increases from $25.50 per hour to $27 per hour.
  • Applicants paid below the median wage may be granted a work visa for up to 24 months. The usual 6-month visa validity restriction is suspended until mid-2022.
  • In certain cases, the labour market test is waived and in some cases, it will still apply.

Employer Accreditation Becomes Mandatory

Employers of migrant workers must become accredited from 1 November 2021 before work visa applications can be processed. Most employers are not accredited. Those that are accredited will have to roll into the new system when it goes live in late September.

  • Government to negotiate and introduce Industry Sector agreements setting minimum conditions for industries that heavily rely on overseas workers. Sectors include; residential care, meat processing, dairy, forestry, road freight transport, tourism, and hospitality. Construction, horticulture, and viticulture may also be included.

  • Base salary to qualify for a Work to Residence Visa (WTR) supported by an accredited employer increases from $55,000 per annum to $79,560 per annum (or $38.25 per hour).
  • Pay rates for WTR visas are now reviewed annually.
  • Work visa applicants paid less than $79,560 per annum by accredited employers need to apply under other work visa categories.

Mandatory Vaccination Required for Travel

From 1 November 2021 anyone who is not a NZ citizen must be fully vaccinated (unless exempt) before travelling to New Zealand. Fully vaccinated means your last dose of vaccine was given at least 14 days before travelling and it was an approved vaccine.

The first wave of applicants can apply from 1 December 2021. Around 16,000 applications are expected in this first wave. The second wave opens on 1 March 2022. In total, the government expects approximately 110,000 applications that will include about 165,000 people.

The Green List

In order to address labour shortages in New Zealand's crucial industries the NZ government has implemented a "Green List" of sought-after high-skill occupations. This list offers a prioritised pathway to residency.

There are qualification and/or occupational registration requirements to meet. Occupations are broken down into two tiers: 

  • Tier 1 - direct pathway to residence
  • Tier 2 - requires a period of two years or longer before applying
