Removal Review Authority

This article is about Immigration Policy but it is not a description of policy. In our opinion simplified descriptions of policy are dangerous. If you want to know why we think that, read “Why things go wrong”.

Removal Review Authority.  Persons liable to removal from New Zealand (usually overstayers, or illegals, but some times persons whose visas have been revoked or cancelled) have a right to appeal against their removal to the Removal Review Authority.
    • Non-refundable fees are payable to the government.
    • Strict time limits apply after the removal decision.
    • Summary results are published (anonymously), so practitioners build a knowledge of precedent, just like in court cases.
The terms of appeal and the case law that has been developed over the years restricts the nature of arguments that are likely to be successful, and relatively few applicants succeed.
